1. SERVICES

Marketing My Clinic LLC facilitates appointment scheduling, consultation coordination, messaging, reminders, informational updates, marketing promotions, and other related communications on behalf of participating clinics. We do not provide medical or dental services directly. Our services include coordinating communications between patients and healthcare providers, managing appointment bookings, sending service-related notifications, and facilitating marketing communications as authorized by participating clinics.

We operate as a service provider and marketing coordinator, working with medical and dental practices to enhance patient engagement and streamline communication processes. All medical and dental services are provided by the participating clinics, not by Marketing My Clinic LLC.

2. ACCEPTANCE OF TERMS

By accessing our website, submitting forms, providing your contact information, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use our services or provide your information.

These terms apply to all users of our services, including visitors to our website, individuals who submit contact forms, and those who opt in to receive communications from us or our partner clinics.

3. SMS/TEXT MESSAGING TERMS

Consent and Opt-In: By submitting your phone number through our website forms, booking pages, or embedded clinic forms, and by checking the explicit consent checkbox indicating your agreement to receive SMS/text messages, you expressly consent to receive SMS/text communications from Marketing My Clinic LLC and our partner clinics. Your consent is voluntary and not a condition of purchase or treatment.

Types of SMS Messages: We may send you two types of SMS/text messages:

• Transactional SMS: These are service-related messages that facilitate your relationship with our partner clinics, including appointment reminders, booking confirmations, scheduling notifications, follow-up service updates, intake questions, and other messages necessary to complete or support your requested services.
• Promotional SMS: These are marketing and promotional messages that may include special offers, treatment promotions, news about services, educational content, updates about clinic services, and other marketing communications.

Message Frequency: Message frequency varies based on your interactions with our services and partner clinics. You may receive messages related to appointments, service updates, and promotional content. We do not send more than a reasonable number of messages per month, and you can control your preferences at any time.

Opt-Out Instructions: You may opt out of SMS/text communications at any time by replying STOP to any message. After you send STOP, you will receive a final confirmation message, and we will stop sending you SMS/text messages unless you re-consent by submitting your phone number and checking the consent checkbox again.

Help and Support: For assistance with SMS/text messages, you may reply HELP to any message. You can also contact us via email at support@marketingmyclinic.com for SMS support or questions.

Message and Data Rates: Standard message and data rates may apply to SMS/text messages sent and received, as determined by your mobile carrier. Marketing My Clinic LLC is not responsible for any charges imposed by your carrier. Please consult your carrier's pricing plan for details about message and data rates.

Carrier Compatibility: SMS/text messaging may not be available on all carriers or devices. We are not responsible for delivery failures due to carrier limitations, device incompatibility, or network issues.

4. EMAIL COMMUNICATIONS

By providing your email address, you consent to receive email communications from Marketing My Clinic LLC, including transactional emails (appointment confirmations, service updates) and promotional emails (marketing offers, newsletters, updates). You may unsubscribe from promotional emails at any time using the unsubscribe link in the email footer or by contacting us at support@marketingmyclinic.com.

We comply with the CAN-SPAM Act and other applicable email marketing laws. Transactional emails related to your appointments or services may continue even if you unsubscribe from promotional emails, as these are necessary for service delivery.

5. PRIVACY & DATA PROTECTION

Your information is collected, used, and protected as described in our Privacy Policy, available at https://marketingmyclinic.com/privacypolicy. We do not sell your personal information to third parties for their own marketing purposes. Marketing My Clinic LLC may share your information with participating clinics for legitimate service coordination purposes and with service providers necessary for SMS delivery (such as Twilio) and other operational functions.

We implement reasonable security measures to protect your personal information, but no method of transmission or storage is 100% secure. By using our services, you acknowledge and accept the inherent risks of electronic communications.

6. USER RESPONSIBILITIES

You agree to provide accurate, current, and complete contact information when using our services. You are responsible for maintaining the confidentiality of your information and for notifying us of any changes to your contact details. You are responsible for any charges your mobile carrier may impose for SMS/text messages.

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our website or services. You will not attempt to gain unauthorized access to our systems or interfere with the proper working of our services.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETING MY CLINIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES OR COMMUNICATIONS.

Marketing My Clinic LLC is not liable for delays, delivery failures, technical interruptions, carrier issues, or other problems outside our reasonable control. We are not responsible for any damages arising from communications delivered to you, including but not limited to missed appointments, scheduling conflicts, or service disruptions.

Our total liability for any claims arising from or related to these Terms & Conditions or our services shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.

8. DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that our services will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant that the results obtained from using our services will meet your requirements.

9. INTELLECTUAL PROPERTY

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, images, and software, are owned by Marketing My Clinic LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

10. GOVERNING LAW

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Champaign County, Illinois.

These terms also comply with applicable U.S. federal laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and other relevant communications and privacy regulations.

11. MODIFICATIONS

We reserve the right to modify, update, or change these Terms & Conditions at any time. We will notify you of material changes by posting the updated terms on our website with a new "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.
